Draft awaiting legal review. These terms have not been reviewed by a lawyer yet and will change before the app launches.
What a record proves, and what it can't
A ClarityCam record documents what your phone captured and what your client signed. It is tamper-evident: if a sealed photo changes, the check fails. It is not a guarantee of any outcome.
A record can show
- The photo has not changed since it was sealed.
- An independent timestamp service certified that a fingerprint of the record existed no later than the stamped time.
- Your client reviewed these photos and signed.
- Whether the phone's time and location checks passed, and how far to trust each one. A GPS position has an accuracy range, and a phone can be set to report a false location; the report says when the phone flagged one.
A record cannot show
- What caused a crack, a stain or any other condition.
- That a scene was not staged.
- That a photo is not a picture of another photo or a screen.
- How a dispute, insurance claim or court case will turn out.
- Anything outside the frame, or anything that happened between two photos.
Whether a record is accepted, and how much weight it carries, is up to the people deciding the dispute. ClarityCam does not give legal advice.
Who can use ClarityCam
ClarityCam is for businesses and their crews. You must be at least 18 and able to agree to these terms for yourself or your business.
The pilot
The pilot is an early version for a small number of crews. Features may change, break or be removed, and the pilot may end. Your first pilot job is free. Keep your own copies of any record that matters to you.
Your responsibilities
- Have the right to photograph the property and anyone in the photos.
- Tell your clients what you record and why, and get their agreement before they sign.
- Do not mark or describe a photo in a way you know is false.
- Follow the laws that apply to your work and your area.
Your records
Your photos and records belong to you. They stay on your phone, and you can export them any time. ClarityCam has no copy, so it cannot restore a record that is lost with a phone. Back up what matters.
No warranty
During the pilot, ClarityCam is provided as it is, without promises that it will be free of errors or always available. To the extent the law allows, ClarityCam is not responsible for losses that come from relying on a record, from lost data, or from the app not working.
Changes and ending
We may change these terms; the date below shows the latest version, and we will tell pilot crews about important changes by email. You can stop using ClarityCam at any time by uninstalling the app.
